telling the defense contractors to hold off on the pink slip warnings and any legal costs they incur will be covered. today we are learning that lockheed and another against firm are listening. now, what is the heck is going on? these are part of the planned sequestration defense-related cuts in the works and they will happen. by obligation, you have to remind the employees affected that they will be affected. now, you don't have to. >>guest: the law says you must give two months notice. that would be the friday before election day. the administration doesn't want the lay off notices so earlier this year, this summer, they said the defense contractors, lockheed market, you don't need to send the notices and look heed said i am not seeing a lost specifics as far as preventing us from going forward with not doing it so on friday the administration offered to pick up the liability because this is the law as well as the costs of limiting the guys go if the layoffs happen. this is a lost deal making, a lot of politics in this situation because the defense contractors big in virginia which

cliff. we could see major cuts in defense spending. given it gets 70% of its sales from the department of defense you can see why people would be nervous. however, i think those worries might be baked into the stock at those levels. it might be exaggerated. plus xls sports a juicy 4% yield. even if the worse does happen they're paying you to wait for washington to sort itself out. the other thing it represents a niche area within the budget. it's not one of those big old cold war programs that they have. i don't know if we should even be that worried. among the other things the company makes is highly secure communication systems, energy analysis, warfare systems, night vision goggles. it also has an information technical side where they do everything from aircraft traffic management for the faa and networks. that's probably less sensitive to the budget cuts we're all so worried about. last quarter was quite strong. if we don't fall off the fiscal cliff this could be the right stock to own. even if we do smash into the fiscal retaining wall, trading at six times next year's earnings. i

. a footnote, this might be a pyrrhic victory for the defense if they win because even if they win with the summers issue, the government can still argue that it was a legitimate, they had a reasonable suspicion, and, therefore the evidence obtained could still be admissible. i was asked to talk about another case which is a case -- >> why don't you take a minute and a half? >> maryland vs. king, and the question is here to the liberty of the state and federal laws that allow for the collection of swabs of cells from the insides of mouths of people who have been arrested. there as 27 states who have laws allow officers to swab the inside of any mouth of anybody arrested, and that gets put into the system who helps to identify the person, but also connect them to other crimes. in this case in maryland, king was arrested for burglary, swabbed, it comes back with a hit for a case involving rape. the court of appeals ultimately found it should have been suppressed, thereby invalidating the law in maryland which is the law in 26 other states allowing that swabbed people are arrested. th

bought that facility, we're told not with money from the defense department, instead the funding is apparently coming from the justice department. congress, by the way, not involved, and some say this is an end run that while it's not illegal in any way, it is highly unusual. in 2009 president obama did send a memo to both the justice and defense d.s to arrange for ownership of the facility and prepare to take on federal prisoners, possibly some from guantanamo bay. a number of republican lawmakers, chief among them congressman frank wolf from virginia, led efforts to block the use of federal dollars so it couldn't be bought. wolf has also said he does not trust the defense department not to send gitmo prisoners to how thompson. senator dick durbin's office confirms the sale. you mentioned the amount, $165 million, and apparently this is a direct deal between the federal government and illinois meaning congress is not involved. durbin's office also says today that gitmo prisoners are not going to be located at this facility. that is the official word. we're working to conform mor

grants. one is in the same-sex marriage cases, the defense of marriage cases and the proposition 8 cases and the other is in the voting rights cases. both of these are likely to be taken on by the courts. we don't know how they will play out because they have not to grant uncertainty in these cases yet. i think they also share some interesting aspects, and those on the relationship between the state and a federal government. first, to turn to the defense of marriage act and proposition 8 cases -- i will talk about doma cases for it. first, for some history on doma, it was passed in 1996 and has two main sections from only one is really at issue in section 2 is about trying to protect states from being forced to recognized marriage in other states. the section that deals with the defense of marriage for federal purposes, federal law, federal taxes, a whole host of bedroll laws. it says, for the purpose of federal law, the word marriage means of a legal union between one man and one woman, husband and wife, and spouse refers only to a person of the opposite sex. that is the section of the

will be watching for is whether the court takes a case on gay marriage or the defensive marriage act. so a lot on the plate and some very divisive and even wedge issues, the court could be deciding this term, ashleigh. >> and listen, joe, as we've been covering the supreme court for the last 20 years, it's no secret that these decisions become increasingly partisan or at least that is the optics out there for those of us who watch this. because those decisions are always right down the line it seems on the big, big topics. in fact sandra day o'connor recently said in an interview said she's distressed about the confidence level in the country. so with these big decisions coming up, is it important for chief justice john roberts to keep that in mind? to keep this confidence level of the united states front and center as this group makes these decisions? >> well, i think right now despite the health care decision that everybody knows about, you still have to say that chief justice roberts is a conservative. and you're right, this court is very evenly divided, sort of four on the right, four on t
